The FSA to inspire trust in consumers and establish the integrity of products, in line with the EU authorities’ position, classified CBD as a novel food. Consequently, it set a deadline for manufacturers to comply with the new food requirements. Some of the guidelines are as follows:

  • CBD products that existed in the UK market before 13th February 2020 must pass the novel food application process by 31st March 2020. And new product products must pass the novel food application process before being allowed into the market.
  • The importation of CBD into the UK does not involve stringent requirements as long as it contains an undetectable amount of THC.
  • One can engage in the sale of CBD in the UK without having a hemp license provided the THC concentration of the products is undetectable.
  • CBD flowers are entirely illegal and their sale, prohibited.
